Terms of Service

By accessing or using AIVideoAI (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including visitors, registered users, and paying customers.

AIVideoAI is an AI-powered video creation platform that allows users to generate scripts, audio, and video content using artificial intelligence. The Service includes script generation via Claude AI, voice synthesis via ElevenLabs, video generation via Replicate, and related tools accessible through our web application.

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when registering.
• You may not share your account with others or create multiple accounts to circumvent plan limits.
• We reserve the right to suspend or terminate accounts that violate these terms.

• AIVideoAI offers free and paid subscription plans. Paid plans are billed monthly or annually.
• All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
• Prices may change with 30 days' notice. Continued use after a price change constitutes acceptance.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Refunds: We offer a 7-day money-back guarantee for first-time paid subscriptions. After 7 days, payments are non-refundable.
• Video quotas reset at the start of each billing cycle and do not roll over.
• Failed video generations (due to errors) do not count against your quota.

You agree NOT to use AIVideoAI to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Impersonate any real person without their consent (deepfakes for deception)
• Generate spam, misinformation, or deliberately deceptive content
• Infringe on the intellectual property rights of others
• Violate any applicable local, national, or international law or regulation
• Attempt to reverse-engineer, scrape, or exploit our API beyond authorized usage
• Use the service in any way that could harm minors
• Generate content that constitutes non-consensual intimate imagery

We reserve the right to remove content and suspend accounts that violate these guidelines without prior notice.

AIVideoAI uses third-party AI models to generate content. We do not guarantee the accuracy, completeness, or fitness for purpose of AI-generated scripts or videos. You are solely responsible for reviewing generated content before publishing or distributing it. AI-generated content may occasionally be inaccurate, biased, or inappropriate — always review before use.

We strive for 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, outages, or factors outside our control. We are not liable for losses resulting from service interruptions. Video generation times are estimates and not guaranteed.

You may cancel your account at any time from the Settings page. Upon cancellation, your account remains active until the end of the current billing period. We may terminate or suspend your account immediately for violations of these Terms without refund.

Upon termination, your right to use the Service ceases. Stored videos will be deleted within 30 days.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

You agree to indemnify and hold harmless AIVideoAI and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

These Terms are governed by the laws of the applicable jurisdiction. Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.

We may update these Terms at any time. We will notify you of material changes via email or a prominent notice on the Service at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
